Summary: We are the data controller. This policy explains what personal data we collect, why, and how we protect it under Mexican law.

Monferatio (hereinafter "we," "us," or "the Portal"), operating the website monferatio.com, is the data controller responsible for the personal data you provide. Our registered address is Av. This Privacy Policy is issued in compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP), its Regulations (Reglamento de la LFPDPPP), and the Lineamientos del Aviso de Privacidad published by the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI).

Summary: We collect only the data you voluntarily provide through our contact and consultation forms.

2. Personal Data We Collect

We collect personal data that you voluntarily provide when using our contact form, free consultation request form, or when communicating with us directly. The categories of personal data we may collect include:

  • Identification data: full name
  • Contact data: email address, telephone number, physical address (if provided)
  • Professional data: company or organization name (optional)
  • Communication data: the content of messages you send us

We do not collect sensitive personal data (datos personales sensibles) as defined by Article 3, Section VI of the LFPDPPP. We do not collect financial account numbers, health information, biometric data, or data related to racial or ethnic origin, political opinions, religious beliefs, or sexual life.

We also collect non-personal technical data automatically through cookies and similar technologies, including IP address, browser type, operating system, pages visited, and session duration. This information is used in aggregate form and is described further in our Cookie Policy.

Summary: Your data is used only to respond to your inquiries and improve our educational content. We do not use it for marketing without consent.

3. Purposes of Data Processing (Finalidades del Tratamiento)

Primary Purposes

The primary purposes for which we process your personal data are:

  • To respond to inquiries and requests submitted through our contact and consultation forms
  • To provide educational information and resources relevant to your inquiry
  • To manage and maintain communication with you regarding your request
  • To comply with applicable legal obligations

Secondary Purposes

If you do not wish your data to be processed for secondary purposes, you may indicate this by sending an email to info@monferatio.com with the subject line "Opt-out secondary purposes." This will not affect the processing carried out for primary purposes.

Summary: We do not sell your data. We share it only with service providers who help us operate the Portal, under strict confidentiality obligations.

4. Data Transfers and Recipients

We do not sell, rent, or commercially transfer your personal data to third parties. We may share your data with the following categories of recipients only to the extent necessary for the purposes described in this Policy:

5. Your Rights (Derechos ARCO)

Under the LFPDPPP, you have the following rights regarding your personal data:

  • Access (Acceso): You may request information about what personal data we hold about you and how it is being processed.
  • Rectification (Rectificación): You may request correction of inaccurate or incomplete personal data.
  • Cancellation (Cancelación): You may request deletion of your personal data when it is no longer necessary for the purposes for which it was collected, subject to applicable legal retention requirements.
  • Opposition (Oposición): You may object to the processing of your personal data for secondary purposes or when processing is based on legitimate interests.

To exercise any of these rights, send a written request to info@monferatio.com with the subject line "ARCO Rights Request." Your request must include: your full name, a copy of your official identification, a clear description of the right you wish to exercise, and any supporting documentation. We will respond within 20 business days of receiving your request, as required by Article 32 of the LFPDPPP.

You also have the right to revoke consent for secondary purposes processing at any time. Revocation does not affect the lawfulness of processing carried out prior to revocation.

If you believe your rights have not been properly addressed, you may file a complaint with the INAI at www.inai.org.mx.

Summary: We retain your data only as long as necessary for the stated purposes and applicable legal requirements.

6. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Policy, or as required by applicable law. Specifically:

  • Contact and consultation inquiry data is retained for a period of up to 24 months from the date of last interaction, after which it is securely deleted or anonymized.
  • Technical and analytical data collected through cookies is retained for periods specified in our Cookie Policy.
  • Data required to be retained for legal or accounting purposes is kept for the period required by applicable Mexican law.
Summary: We use appropriate technical and organizational measures to protect your data from unauthorized access or disclosure.

We implement administrative, technical, and physical security measures designed to protect your personal data against unauthorized access, loss, misuse, alteration, or destruction. These measures include, among others:
